What are Michigan’s rules about drinking and fishing?

Many people like having a few drinks with their friends while they are out on the water. While this can sound like an idyllic afternoon, it’s crucial to understand the state’s laws regarding alcohol consumption on boats.

What the laws say

Passengers on boats are allowed to consume alcohol. This means that while on a fishing boat, Michigan residents who are of legal age can enjoy beer or other alcoholic beverages if they choose to do so.

However, Michigan has several laws regarding alcohol and boating. Perhaps most importantly, Michigan has laws against operating a boat while under the influence of alcohol (BUI). On a related point, a boat owner or the person in charge of a watercraft may not permit someone to operate the boat while under the influence.

Michigan also has rules that limit alcohol consumption on or around boats. Many state parks do not allow drinking during the warmest months of the year. Further, in many ports and harbors on state property, while people may have alcohol, they may not consume it or have an open container.

Possible consequences for drinking and boating violations

Someone convicted of boating under the influence can face penalties similar to what people receive after a drunk driving conviction. Jail time, community service and other fines and fees are possibilities. A person could also have their driver’s license suspended for a BUI offense.

The penalties are more serious for repeat offenses. Similarly, if an accident involving alcohol leads to serious injury or death, the operator of the boat could face a felony charge and years in prison.

Protecting boaters’ rights

Those accused of boating under the influence should make sure they understand their legal rights and options. Defenses may be available to those accused. For example, authorities must demonstrate that they had the legal right to board the boat and that they administered sobriety tests correctly.

Enjoying a drink while fishing on Michigan’s beautiful waterways often goes hand-in-hand, but it’s crucial to prioritize safety and adhere to state laws. By understanding and respecting these regulations, you can ensure that your fishing trips remain both enjoyable and trouble-free.
