Determining Child Custody In Michigan

It is entirely natural for parents to want to protect their children's best interests. Similarly, the law says that all child custody, visitation and child support issues are to be made based on the best interests of the child.

Generally, if parents can work together and come to an agreement on a parenting plan, then the court will approve it. If there is a disagreement, our skilled custody lawyers can help you resolve it through negotiation, mediation or in court. There are a few different types of custody that we can help you consider:

Physical custody: Typically, one parent receives primary physical custody, which means the child lives with that parent most of the time. The other parent is usually given visitation rights (parenting time).

Legal custody: The parent with legal custody has the right to make decisions about the child's medical care, religious upbringing, schooling and many other aspects of the child's upbringing.

Joint custody: It is common for both parents to have input on the child's upbringing, even if the child lives primarily with one parent. Joint custody arrangements include frequent parenting time for the noncustodial parent.

Sole custody: In some situations such as when one parent is incarcerated, leaves the country or is abusive, the other parent can be awarded exclusive physical and legal custody.

After the initial custody determination is made, you and your family may need to modify the arrangement. This frequently happens when a parent gets a new job and needs to relocate and when other major life events occur. We can help you pursue a modification of child custody so that you can continue having a healthy relationship with your kids as life changes.
